Analysis: 10 years post-marriage equality, many same-sex parents are still campaigning for legal recognition of their families When the Children and Family Relationships Act was signed into. In the run up to the marriage referendum, one of the key pieces of legislation that was on the table was the Children and Family Relationships Act This was viewed as an important piece of legislation, not just to formalise guardianship and parenting issues, but also so that the conversation during the referendum would be focussed on extending marriage rights to same-sex couples. Same-sex couples, single parent families, divorced parents, children raised by grandparents, and countless other blended family units resisted such a narrative. When I started my research in this field, there was no mechanism in Irish law whereby both members of a same-sex couple could be jointly recognised as the legal parents of the same child. Since , it has been possible for both members of some female same-sex couples to be jointly recognised as the legal parents of their child, but many others are excluded from legal recognition depending on how the child was conceived. My kids go to a country primary school with a few hundred kids in it, and to be fair, it's very inclusive. There are a lot of different types of family setups these days. Cant say I know of any same sex couples in the school, but I know of a few personally, and they dont seem to have any problem. As we celebrate pride week this week, it is important to cast an eye over the development of the recognition of parental rights for same-sex couples in Ireland over the last number of decades and to the difficulty which many same-sex couples continue to face in Ireland today. In doing so, this short piece will consider how a lack of legislation and regulation is leaving perspective same-sex parents in a precarious position legally as they fight for recognition of their parentage over children who in many circumstances, will otherwise be considered strangers in law to themselves.
